    Warranty Policy for Nimbus Mattress Products:

General Provisions: This document elucidates the warranty service conditions provided by Nimbus Mattress ("the Company"). The Company's mattresses are designed to enhance your sleeping comfort and are substantiated by this warranty against certain product deficiencies, subject to the terms and conditions herein.

Warranty Coverage and Period: The Company warrants the original purchaser ("the Purchaser") of this mattress that during the period of ownership, the mattress will be free from manufacturing defects in workmanship and material, as detailed within this policy.

Body Impression Warranty: Significant body impressions on the mattress, constituting a visible indentation or sag of two (2) inches or more that is not associated with an indentation or sag resulting from use of an improper or unsupportive foundation or adjustable bed base, shall be deemed a warranty defect. Such a defect, upon thorough evaluation, merits the activation of warranty service.

Void of Warranty: Please note that any damage to the mattress including, but not limited to, rips, tears, and stains, initiated by the Purchaser post-purchase, will void this warranty. The Company unequivocally suggests the Purchaser make an ancillary purchase of a mattress protector to safeguard the integrity of the mattress, and by extension, this warranty.

Legal Remedies: All claims in relation to this warranty will be governed by the laws of the state in which the original transaction was completed, unless otherwise explicitly stated. This warranty gives the Purchaser specific legal rights, and the Purchaser may also have other rights, which vary from state to state.

            Limitations and Exclusions: EXCEPT AS OTHERWISE EXPRESSLY STATED HEREIN, THE COMPANY MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS COVERED BY THIS WARRANTY, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

            

    This warranty is in lieu of all other express warranties. The duration of any applicable implied warranties, including but not limited to the implied warranties of merchantability and fitness, is limited to the term of this express warranty. The Company's sole liability shall be the repair, replacement, or pro-rated replacement as contained herein. Under no circumstances shall the Company be liable for any incidental, special, or consequential damages, whether direct or indirect.
